SHOULD BURNING THE AMERICAN FLAG BE ILLEGAL? Trump appears to be setting up a Supreme Court battle with his new Executive Order arguing that "burning this representation of America may incite violence and riot". With Trump saying, "If you burn a flag, you get one year in jail". While the Supreme Court has previously said flag burning is protected under the 1st amendment, we now have a much more conservative, heavily Trump appointed Supreme Court in place today.
